Terms of Service

Please read these Terms carefully. They include an agreement to resolve disputes by binding arbitration on an individual basis (Section 17) and a class-action waiver. They affect your legal rights.
1. Acceptance of These Terms
Welcome to Cheer Team. These Terms of Service (the “Terms”) are a binding agreement between you and Dame Enterprises (dba Cheer Team) (“Cheer Team,” “we,” “us,” or “our”). They govern your use of our mobile applications, websites, and related services (together, the “Service”).
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
2. Who May Use the Service
You may create a Cheer Team account only if you are at least eighteen (18) years old and have the legal capacity to enter into these Terms. Athletes ages 13 through 17 may use the Service only with an account created by, and with the active supervision of, their parent or legal guardian. Children under 13 may not have their own accounts; their information is managed by a parent, guardian, or coach on their behalf, as described in our Privacy Policy.
You may not use the Service if you have previously been suspended or removed by us, or if you are barred from doing so under applicable law.
3. Definitions
- “Program” means a cheer team, squad, club, or other organization registered on the Service.
- “Coach” means the person who creates and administers a Program, including any assistant coaches or team administrators authorized to act on the Program's behalf.
- “Athlete” means a person who is a member of a Program for the purpose of participating in cheer activities.
- “Parent” means a parent or legal guardian of an Athlete who uses the Service to receive communications, pay dues, and otherwise participate in the Program on the Athlete's behalf.
- “Content” means anything you upload to or share through the Service, including text, photos, videos, audio recordings, files, and any other material.
4. Account Registration and Security
To use most features of the Service you must create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it accurate, current, and complete;
- Maintain the security of your account and your authentication credentials (including Apple, Google, or other sign-in providers);
- Notify us promptly at support@cheerteam.app if you discover or suspect unauthorized access to or use of your account;
- Accept responsibility for all activity that occurs under your account.
5. Subscriptions, Billing, and Refunds
5.1. Subscription Plans
Some features of the Service require a paid subscription (each, a “Subscription”), purchased through Apple's App Store or Google Play. Current plans, prices, and the athlete limits associated with each tier are shown in the Service before you purchase.
5.2. Auto-Renewal
Subscriptions are auto-renewing. Payment will be charged to your Apple or Google account at confirmation of purchase, and your Subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the prior renewal. You can manage and cancel your Subscription by going to your Apple App Store or Google Play account settings after purchase.
5.3. Free Trials
If we offer a free trial, you must cancel before the end of the trial to avoid being charged. Any unused portion of a free trial is forfeited when you purchase a Subscription.
5.4. Refunds
All purchases are processed by Apple or Google. Refund requests must be submitted through Apple or Google's standard processes. Cheer Team does not directly process refunds for Subscriptions purchased through the App Store or Google Play.
5.5. Dues Collected from Parents
The Service includes a payment-processing feature that lets Coaches collect dues from Parents using Stripe Connect. When a Parent pays dues:
- Stripe collects the payment from the Parent and routes the funds to the Coach's connected Stripe account.
- Cheer Team is not a party to the underlying transaction between the Coach and the Parent. We do not hold the funds, set the prices, or guarantee the services for which the dues are collected.
- Refunds for dues are handled by the Coach and Stripe. Cheer Team does not process dues refunds.
Your use of Stripe is governed by Stripe's Stripe Connected Account Agreement (for Coaches) and Stripe's Privacy Policy.
6. Acceptable Use
You agree not to:
- Use the Service in any way that violates any applicable law or regulation;
- Harass, threaten, intimidate, or impersonate any person, including any minor;
- Upload, post, or share Content that is sexually explicit, abusive, hateful, harassing, violent, deceptive, or otherwise objectionable, especially when minors are involved;
- Solicit personal information from a minor or otherwise use the Service to contact a minor outside of an appropriate program context;
- Upload Content that infringes anyone's intellectual property, privacy, publicity, or other rights;
- Send spam, chain letters, unsolicited promotional messages, or mass communications unrelated to a Program;
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
- Probe, scan, or test the vulnerability of the Service; interfere with or disrupt the Service; or use any robot, crawler, or scraper to access the Service;
- Reverse engineer, decompile, or disassemble any part of the Service except to the extent applicable law expressly permits;
- Use the Service to compete with us, including building a competing product or replicating its design.
7. Reporting and Moderation
The Service includes tools to report inappropriate Content and users. If you become aware of Content or behavior that violates these Terms, please use the in-app report feature or email support@cheerteam.app. We commit to reviewing reports of objectionable Content within 24 hours and removing Content or restricting accounts as we deem appropriate. Egregious violations — including any Content depicting the sexual exploitation of a minor — will be reported to law enforcement and the National Center for Missing & Exploited Children as required by U.S. law.
8. User Content
8.1. Your Ownership
You retain ownership of all Content you submit. You are responsible for your Content, including its accuracy, appropriateness, and your right to share it.
8.2. License to Cheer Team
By submitting Content to the Service, you grant Cheer Team a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as resizing), distribute, and display your Content solely to provide the Service to you and other authorized members of your Program. This license ends when you delete your Content from the Service, except that we may retain copies in backups for a reasonable period.
8.3. Removal of Content
We may remove Content that violates these Terms or that we believe poses a risk to users, the Service, or third parties. We may do so without notice. Coaches may remove Content from their own Program for any reason.
9. Coach and Program Responsibilities
If you create or administer a Program, you make the following additional commitments:
- Authority. You have the right to operate the Program and to add the Athletes and Parents you invite or enter.
- Parental consent. Before adding a minor Athlete or Parent to your Program, you have obtained any consent required under applicable law and your local regulations.
- Youth protection. You will comply with the U.S. Center for SafeSport Minor Athlete Abuse Prevention Policies (or your equivalent local youth-protection rules), including limitations on one-on-one contact and electronic communications between adults and minors.
- Accurate billing. Charges you issue accurately reflect amounts owed for goods or services the Program is authorized to collect.
- Stripe compliance. You comply with the Stripe Connected Account Agreement, including providing accurate business information and not using Stripe to process transactions outside the Program's normal cheer-related activities.
- Roster accuracy. Information you enter about other people (Athletes, Parents) is accurate and lawful for you to share with Cheer Team.
10. Intellectual Property
The Service, including its software, design, text, graphics, and the “Cheer Team” name and logo, is owned by or licensed to Cheer Team and is protected by U.S. and international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. All rights not expressly granted to you are reserved by us.
11. Feedback
If you send us feedback, suggestions, or ideas about the Service, we may use them without obligation to you. You grant us a perpetual, irrevocable, royalty-free license to use your feedback for any purpose.
12. Third-Party Services and Links
The Service integrates with third-party services such as Stripe, Google Calendar, Apple Calendar, Apple Music, and the Apple and Google authentication and billing systems. Your use of those services is subject to their respective terms.
13. Termination
13.1. Termination by You
You may stop using the Service at any time. To delete your account, go to Settings → Legal → Delete my account in the app or email support@cheerteam.app. Account deletion is described in Section 8 of our Privacy Policy.
13.2. Termination by Us
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, if your account is inactive for an extended period, or if we are required to do so by law.
13.3. Effect of Termination
On termination, your right to use the Service ends immediately. Sections 8 (your license to us, with respect to Content already shared), 10-12, 14-17, and 18-19 survive termination.
14. Disclaimers
The Service is provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, Cheer Team disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. You use the Service at your own risk.
15. Limitation of Liability
To the fullest extent permitted by law, neither Cheer Team nor its officers, employees, agents, or affiliates will be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with these Terms or your use of the Service, whether based in contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
16. Indemnification
You agree to indemnify, defend, and hold harmless Cheer Team and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your Content;
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any law or the rights of any third party, including any Athlete or Parent in a Program you administer.
17. Dispute Resolution; Binding Arbitration
17.1. Informal Resolution
Before filing a formal dispute, you and Cheer Team agree to try to resolve the dispute informally by emailing support@cheerteam.app with a description of the dispute. We will attempt to resolve the dispute by responding to your email within 30 days.
17.2. Binding Arbitration
If we cannot resolve the dispute informally, you and Cheer Team agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures. Arbitration will take place in Utah, United States, or another mutually agreed location. The arbitrator's decision will be final and binding. This provision is governed by the Federal Arbitration Act.
17.3. Class-Action Waiver
You and Cheer Team agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If a court or arbitrator finds this class-action waiver unenforceable, the unenforceable portion will be severed and the rest of this Section 17 will remain in effect.
17.4. Opt-Out
You may opt out of arbitration by emailing support@cheerteam.app within 30 days of first accepting these Terms. If you opt out, neither you nor Cheer Team is bound by Section 17.2 or 17.3.
17.5. Exceptions
Either party may bring an action in small-claims court for disputes within the court's jurisdiction, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the misuse of intellectual property.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. For disputes not subject to arbitration, you and Cheer Team consent to the exclusive jurisdiction of the state and federal courts located in Utah.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have given us an email address) and through a prominent notice in the Service before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your agreement to the updated Terms.
20. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Cheer Team about the Service.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, or sale of assets.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
- No third-party beneficiaries. Except as expressly stated, these Terms do not create any third-party beneficiary rights.
